Rape Victim Speaks Out After Suit Tossed

(April 4) - A woman who was sexually assaulted in a New York City subway said she was stunned by a judge's decision to toss her lawsuit claiming that two transit workers ignored her pleas for help.
Queens Supreme Court Justice Kevin Kerrigan ruled earlier this week that the workers had taken "prompt and decisive action” when they called the command center to notify police, the New York Post reported. But the victim, identified as Maria Besedina, 25, argued they could have done more to save her from her horrific ordeal. She filed the suit against the city’s Metropolitan Transit Authority.

Besedina came forward Thursday to tell her story following the judge's decision. "It's been extremely difficult to hear," Besedina told the Post. "The MTA did nothing."
Besedina said she was riding a train on June, 7, 2005, when another rider began touching her feet. He followed her off at a station stop and dragged her down a stairwell. "I held [the token booth clerk's] gaze for at least five seconds, yelling and screaming, 'Help! Help!'” she told the New York Daily News. "I saw him and I thought, 'Oh gosh, he's gonna see me, it's gonna be okay’ and – nothing." A conductor also witnessed the attack from the window of his train.
She said her attacker held her over the tracks as he assaulted her. "I was just shaking and thinking that I was dead, I was as good as dead,” she said.
By the time cops arrived 10 minutes later, the attacker escaped. Police have not arrested any suspects.
Besedina said she continues to suffer from extreme anxiety from the incident. She said she plans to appeal the judge’s ruling.

I was raped by a man with no weapon. I was 16 & scared to death. I SAID NO & tried to leave but he wouldn't let me. You ******* men have no idea what it's like to be in that situation.

I agree that the workers could have, and morally should have done more then push a button. On the other hand, trying to hold the transit authority responsible for what amounts to a personal decision on the part of the 2 workers as to whether to endanger themselves on her behalf or not, is wrong.Would I have physically attempted to come to her aid? Yes, I think I would have.That does not mean they are guilty of a crime though, or that the transit authority is accountable. I most certainly do wish her the best in recovering from this attack.

If she was dragged down a stairwell who even saw this "rape"? After the Duke lacross fiasco I don't automatically assume someone was raped just because they say so.

The problem stems from the N.Y laws that take away people's right to defend themselves, including carrying a defensive weapon. This is a Perfect example of what happens when you disarm citizens: the criminals have a field day and will attack you at will. So many citizens here in Florida carry concealed weapon permits that something like this would be extremely rare, to non-existent in a public place (because the bad guys know we're armed). But even if it did, (yes i know we don't have subways), there would have been at least two or three people with guns who would have stopped the rapist. Here in Florida, according to FDLE (Florida Dept of Law Enforcement), "rape and violent street crimes" are DOWN 22- 41%, and home invasions are down nearly 28%, "all because citizens are lawfully armed". The cops know it, the FBI knows it, and so do the bad guys. Any politician who tries to take away your God-given and constitutional right to defend yourself and your family, has directly placed y...

About the subway workers doing enough. Of course they did enough. Anyone who expects someone to come to physical aid against an attacker for a stranger is a retard. This isn't the "olden days". If you are dumb enough to give it up to someone with no weapon and claim you were raped with plenty of people around then You Especially should not complain. Hell you couldnt protect yourself against extremly favorable odds a simple 1 v 1 scuffle. Why should anyone come to help you if you cant even put up a fight.Why should someone risk their own lives and family lives for a complete stranger? Some stupid Fox News lady Lindsay or something said they should have shouted something over the P.A. system... they already hit the panic button for cops to show. She actually doesnt look too bad. Normally you see ugly whiney girls who you look at and think "Riiiight someone would try to rape you... LOL" but its almost beliveable. Except for the part with her not being injured... um.. and there was no weapon involved. How the hell? She wasn't raped it was staged and this is a silly scam.Anyone who gets "raped" by someone and doesnt even get hurt A) Deserved it hands down. or B) Wanted it. And this "attacker" didnt even have a weapon.. no gun or anything thats crazy. If you get "raped" and you didn't fight back that sounds like you didn't get raped. As a matter of fact it sounds like someone's lying.Any one who claims something like this deserves it assuming what they claim is true. Hell now I know that you could just walk up to a girl and scream at her ...maybe rudely grab her arm and she'd gladly give it up ... You people who think she got what she deserved and/or is just looking for money are disgusting. Where is your empathy? I think a woman she be able to drive a subway train at night and not have to worry about her safety. She did nothing wrong. The MTAs should have at least shouted at the guy or something other than just calling the police. It's cowardly and a shame that people are that uncaring. The world has become a sad place.

It is the American Way--Blame someone else for YOUR mistakes if you think you can make money from them. A woman, alone, walking into an empty NYC subway at 2AM and she is blaming people who did their job according to their job descriptions to the best of their abilities. SHE did not take personal responsiblity for her own actions and safety in this situation. This occurred after she left her boyfriend's apartment. Why didn't he walk her to her subway? Or better yet, to a taxi? He didn't care enough for her safety either and if I were her, I'd dump him. I'm glad that the court dumped her lawsuit, which will be appealed and she'll collect something because it will cost the Defendant (the Subway system, whatever is it's legal name) attorney's fees to defend the suit at which time it becomes a business decision. Pay the plaintiff or pay your attorney's fee to defend it. It's cheaper to pay the plaintiff and end it so I predict she'll, or rather her attorney, will get something. And her...

The judge has to think, legally, were they negligent. Selfishness is not a crime, when they called the police they legally did what every citizen is responsible to do. Thats all there is to it, it doesnt matter where your morale's are, whether you think it was right or wrong, it sucks because thats not how the legal system works. it works on legality, and aside from calling the police they are not legally bound to put themselves in a situation in which they feel they will be put in danger. From a completely legal standpoint, the judge made the correct call, no matter how unfortunate it is...and how sick the people are for ignoring her.
