Kyla Ebbert, the 23-year-old college student and Hooters waitress who made news earlier this year when she was asked to leave a Southwest Airlines flight for wearing a skimpy outfit, has decided to grab a few more of her fifteen minutes of fame by posing nude for Playboy. She gives the usual acceptable reasons -- the female body is a beautiful thing (true), it was very tastefully done (remains to be seen), her boyfriend was supportive (does he have a choice?). The spread, which includes both lingerie and lingerie-less photographs, is called "Legs in the Air." Can anyone think of a better title? Here are some suggestions, or send in your own.

Following your RHCP logic, Mr. Greenman, BP should write an entire story about a 23 year old hooters waitress thrown off an airplane for wearing (arguably) "too skimpy" an outfit, and then they should do a photo spread of a woman who looks, and who is also aditionally made up to look like - the watiress, as she was in the news photos. And then she should have no right to sue playboy for using her story and likeness.
It would be a tough case and their are reasonable arguments either way.
But you seem completely unaware that IP has at least something to do with adding dollars-and-cents value and marketability to otherwise obscure or extremely general and not, of themselves, marketable (nay, marketed) ideas. I understand why you so strongly want to hold the line on the side fo 'free speech' over 'IP' as a first ammendment supporter and a journalist. However, I think that if you apply that logic to cases, you'll see that the distinction isn't 'is it possible for a person to think of something?" - but "How- through whom-- did the idea become known a broad general public, and attain a high marketable cash value?"

18. First of all, Ben, you shouldn't be worried about the boyfriend. It's not his business what she doesn't wear for the camera (although it's rather sweet that she should be concerned about his reaction).
Second of all, while the airline might have a right to insist that the girl put on actual clothes, unless she's waving all her parts naked in the passengers faces, it's not their business what she wears (or doesn't wear) either.
And third of all - I just hope this girl turns the money she makes from her 15 minutes of fame into something useful - money market funds, more college funding, etc. If she doesn't put it up her nose, I'll feel like she's vindicated. (Although what she does with her money isn't MY business EITHER...)
