<p><a href="http://www.redstate.com/stories/law/5_4_supreme_court_bars_death_penalty_for_child_rape">On the heels of today's SCOTUS decision in <em>Kennedy v. Louisiana</em></a> barring the death penalty for sex offenders, Gov. Bobby Jindal released a statement calling the ruling an "affront to the people of Louisiana" - and what's more, vowing to do whatever possible to amend the state's laws in order to maintain the death penalty for child rape.</p>
<p>But that's not all he did. </p>
<p>Today, Gov. Jindal signed the "Sex Offender Chemical Castration Bill," authorizing the castration of convicted sex offenders. They get a choice: physical or chemical. Oh, and they don't just get castrated and leave - they still have to serve out their sentence.</p>

<p><br />The Supreme court said that death was out of proportion to the crime. I wonder if this is proportionate enough for them. This issue hasn't been on the radar screen of the public consciousness until this ruling, and I wonder if it won't have the adverse effect of triggering many laws targeting child rapists. <blockquote>Senate Minority Leader Mitch McConnell dropped by our offices in New York this week. Republicans face potential electoral disaster this fall, but he says a few issues could turn out to be lifesavers. Case in point: Gas prices, at more than $4 per gallon for the first time in history. Mr. McConnell notes that a new poll shows Americans now favor drilling for oil in the Artic National Wildlife Refuge 57% to 41%. That's up from a nearly even split before consumers were getting socked at the pump. Asks Mr. McConnell: "<strong>At what point does the hammerlock the Sierra Club has on the Democrats come off? Is it $5? Is it $6?"</strong><br /></blockquote>

<p>The hammerlock comes off at $4 as the poll shows, but the effort is complicated by a few things. One is that there are many other issues on the table which cut against Republicans. The other big complication is that John McCain is still in "maverick" mode and has not figured out that gas prices and drilling are winning issues for the GOP. </p>
<br />
<p>So the key question is not what the Democrats will do, they are locked in between working class voters on one end and upper class yuppies with a penchant for green living on the other end. Who will win? The Democrats hope to never have to find out. So they blame the oil companies and hope no one asks them serious questions.</p>
<br />
<p>No, the real interesting question is at what point does it behoove John McCain to put together a serious plan to address energy issues that has a credible chance at lowering energy costs? $5, $6? <p>I have my doubts. Oh, no doubts about Hillary's willingness to be a Tonya Harding, or her willingness to send out Bill or anyone else to play Jeff Gilooly. No, my doubts center more around if she can destroy Obama. If she had a dealbreaker for Barack, it would have been deployed by now.</p>
<p>The time to do so would have been super Tuesday or sooner. As much as I'm enjoying the thought, I think Obama's too strong and even slimy dirty attacks will reach a point of diminishing returns for Hillary. And it is sophisticated, according to the <a href="http://www.algore.org/">website</a>: they have 2354 volunteers and 271 groups. And with the continuing reluctance to whole heartedly embrace Hillary Clinton and much dissatisfaction over alternatives Edwards, Obama, Richardson and the rest. Al Gore is the only one who could turn this race upside down.<p> </p>

<p>But it appears to be all in vain. The leader of the Draft Gore committee wrote a letter, published at <a href="http://www.dailykos.com/story/2007/11/13/02538/096">DailyKos</a>, where she reveals that Al Gore himself is telling them to knock it off:</p>

<p>Dear AFG Steering Committee Members:</p>
<p>We have received a communication from a member of Al Gore's staff discouraging our efforts to put Al Gore's name on any primary ballots. This includes California, New York, Massachusetts, and the write-in effort in New Hampshire, as well as any other states that are working to get him on the ballot. Accordingly, effective immediately, we are recommending that all groups cease their signature collection and related fund-raising activities.</p>

<p>Well. That's that then. The biggest obstacle between Hillary and the Democratic nomination is now gone for sure. Political junkies will all mark this as a sad day, for now it seems quite clear that nothing interesting will happen on the Democratic side of the race until the convention.</p>

For a while, it looked like Schweitzer's popularity in his home state, combined with his significant fundraising prowess, had scared away all would-be challengers. But these past weeks have seen the emergence of a potentially strong candidate: State Senator Roy Brown of Billings.Election observers in Montana know that Brown has a few assets: a tenacious work ethic, a semi-retired status that will allow him to campaign full-time, a strong fundraising base, an ability to self-fund if he needs to, and a base in the major swing county of Yellowstone, where he represents the heart of Billings, Montana's largest city.<br /><br />And there's no doubt that he's already working hard. As Montana Headlines, a conservative Montana blog, has been tracking, Brown is <a href="http://montanaheadlines.blogspot.com/2007/11/sen-brown-continues-his-trip-around.html">stumping hard</a>.<br /><br />Still, Brian Schweitzer has big approval ratings, a ton of cash on hand, and the ability to take advantage of a big Get Out The Vote effort for Democrats headed by Senator Max Baucus, who will raise and spend millions.<br /><br />My early prediction is this: Without any good reason to fire Brian Schweitzer, Roy Brown is best off using this race to build a statewide profile, stay positive, and develop a likeable profile among the electorate. He could also go negative hard and try to win -- but this doesn't have to be his last race. This is a political blog. And it is Election Day in a few states. Dave already <a href="http://news.aol.com/political-machine/2007/11/06/dont-forget-to-vote/">talked</a> about three races to watch. But he missed a few key ones -- especially ones that will determine strategies for 2008. In Virginia, Kentucky, Oregon, and a handful of other places, statewide races, legislative fights, and ballot measures will tell us a ton about how the parties plan to duke it out in 2008.<br /><br />First stop Virginia. Look out Republicans, this state has been trending bluer and bluer lately. That explains why local Republicans are looking to the hot issue of immigration as an <a href="http://marcambinder.theatlantic.com/archives/2007/11/its_hard_getting_on_the_virgin.php">election firewall</a>. If the strategy works, expect to see it go even more national next year. If it doesn't, it is back to the drawing board for the GOP.<br /><br />Next stop: Kentucky.There's little doubt that corrupt incumbent Ernie Fletcher is going to lose to challenger Stephen Beshear -- the big question is how well the last minute <a href="http://talkingpointsmemo.com/archives/058021.php">dirty attacks</a> will work to hurt Beshear. Why does all of this matter for '08? Well, it turns out that Kentucky's Senior Senator Mitch McConnell also happens to be Minority Leader, his approval numbers are hurting, and he just could end up in Democratic cross-hairs next year. If the Democrats get an added bonus of a successful campaign operation and a Governor's office in full-swing, give McConnell's challenger a better shot. And McConnell's had to hang out with the doomed Fletcher -- no bueno just before a tough election.<br /><br />Out in Oregon, keep an eye on both statewide ballot measures. Voters in Oregon will consider reforming an extreme right-wing land use planning measure that was copied (with little success) in states all over the country last year. If Oregon's voters ditch the effort, expect to see its national backers less likely to pony up for similar efforts elsewhere.<br /><br />Oregon is also voting on a tobacco tax-funded expansion of children's health care. The tobacco industry has pulled out all the stops to kill the effort -- knowing that if successful, the strategy will be replicated elsewhere. It was engineered in 2000 to be a safe Republican district but population shifts in the years since have altered the demographics so that it's more friendly to Democrats. In 2006 veteran congresswoman Deb Pryce barely, and I mean by the skin of her teeth, beat back a challenge to Mary Jo Kilroy.
<p> </p><p>Earlier this year Pryce announced that she would not run again, leaving Kilroy, a Democrat as the default favorite and this district rated as a highly likely flip to the Democrats. Even worse, until now, the Ohio Republicans have not been able to recruit a decent candidate to challenge Kilroy and keep the seat in GOP hands.</p>

<p><a href="http://www.dispatch.com/live/content/local_news/stories/2007/11/05/stivers.ART_ART_11-05-07_A1_IK8CHC8.html?type=rss&amp;cat=&amp;sid=101">Until today</a>. As tipped by <a href="http://www.rightangleblog.com/2007/11/04/oh-15-steve-stivers-will-announce-his-candidacy/">RightAngleBlog</a>, Steve Stivers is announcing today that he will run for congress in this district. He was the first choice and many were disappointed when he did not immediately accept the challenge. A quick look at his <a href="http://www.senatorstevestivers.com/about/">biography</a> and the Dispatch article tells us why.</p>

<p>But Stivers offers a new challenge, because as a lieutenant colonel in the Ohio Army National Guard, he has led troops in the Iraq war. Stivers and other members of the Columbus-based 237th Personnel Services Battalion returned from a 12-month tour of duty in the Middle East and Africa in December 2005.</p>

<p>"Oddly enough, it's almost like Mary Jo Kilroy is the incumbent this time," Stivers said. "It will be a very different race than in 2006. The voters know her and they need to get to know me."</p>
<p>Almost all of Stivers' 16th state Senate district, except for the city of Dublin, lies within the 15th Congressional District. </p>

<p>Looks like OH15 will be another barnburner of the race. The demographics don't favor either party anymore, and Mary Jo Kilroy has <a href="http://time-blog.com/real_clear_politics/2007/10/gop_challenge_in_oh15.html">piled an impressive</a> $425,000 already. Last year, Pryce spent more than $2,000,000 to defend her seat and this year it will probably take more than that to win.</p>

<p>Even more importantly the inability to recruit a top candidate to a current Republican occupied seat was seen by many as a sign of how listless the Ohio Republicans have become and a further encouragement to Ohio Democrats. But apparently there are some signs of life in the ORP. </p>

Consider the evidence: Gregoire's victory took something like 3 counts and when all was said and done, she won by 179 votes; Rossi effectively positioned himself as the wronged moderate in a ticket-splitting state -- think a Gore rerun in 2004 if 9/11 had never happened; and Rossi has been raising and campaigning through "Forward Washington" a front-group he set up to keep his name in the papers (Forward WA is not related to 'Forward Montana' -- the non-profit I work for, which is not a Dino Rossi front group).<br /><br />To boot, Gregoire's approval is <a href="http://www.surveyusa.com/client/PollReport.aspx?g=696f95da-c694-48d0-a1e5-ea9848d3e756">barely above 50%</a> -- so shouldn't she be nervous?<br />Probably not. The partisan landscape is still pretty awful generally for Republicans. And Dino Rossi isn't doing himself many favors by <a href="http://slog.thestranger.com/2007/10/im_not_in_congress_dino_rossi_on_childre">ducking questions</a> about the State Children's Health Insurance Program. (Note: There is only one popular answer to the question of whether you support more health insurance for poor kids. It is 'yes.')<br /><br />And while Dino Rossi has been raising funds and campaigning through a non-profit, he still hasn't raised a dime of partisan money.<br /><br />Finally, while the partisan landscape for the GOP is bad nationally, it could very well be worse in Washington State. The Democrats made huge statehouse gains in 2006. And the state is Ground Zero in the lingering U.S. Attorney scandal. John McKay, the former U.S. Attorney for Western Washington, was purged from the U.S. Department of Justice in an incident likely to remain in the news for a while. The reason for McKay's purging?<br />
<ol>
    <li>Either <a href="http://jamesfallows.theatlantic.com/archives/2007/05/the_firedattorneys_case_a_trul.php">investigating the death</a> of a subordinate killed in the line of duty -- in an investigation likely to anger pro-gun extremists (note: I like guns, I just agree with the majority of Americans who think we can both keep guns legal and have some common sense restrictions). OR</li>
    <li>Investigating allegations of voter fraud during the 2004 Governor's race, concluding there wasn't a case, and declining to prosecute -- a move that partisan Republicans held against a long-time GOP prosecutor.</li>
</ol>
In other words, the Washington Republican Party has some issues. And Dino Rossi is likely to be dragged down by them.<br /><br />So is the race a snoozefest? Probably not -- it's still on the radar as one to watch. But right now the smart money says Christine Gregoire is the favorite to win. Jindal, who beat 11 other contenders, becomes the first non-white governor since Reconstruction.The AP notes:<br /><blockquote><em>The Oxford-educated Jindal had lost the governor's race four years ago to Gov. Kathleen Blanco. He won the a congressional seat in conservative suburban New Orleans a year later but was widely believed to have his eye on the governor's mansion. Blanco opted not to run for re-election after she was widely blamed for the state's slow response to hurricanes Katrina and Rita in 2005. </em>
<p><em>When he takes office in January, Jindal will become the nation's youngest governor in office.</em> </p>
</blockquote>Jindal's victory is a boon to the GOP's national morale. In the home state of Hurricane Katrina's biggest impact Republican s have demonstrated their brand is salvageable. Most politics are local and this election was no different. The campaign was a referendum on the corruption and incompetence of the Democratic incumbent and officeholders that have held up recovery efforts.
