Father Banned From Son's Graduation

ST. JOSEPH, Mo. (May 10) - School and law enforcement officials have told a St. Joseph man that he can't attend his son's eighth-grade graduation because he is a convicted sex offender and isn't allowed on school property.

James Jones, 36, said he may go anyway although the Buchanan County Sheriff's Department has told him he would be arrested and face up to four years in prison.

"I've already been punished for this. This isn't about me anymore. Now they're punishing my kids, and that's taking it a little too far," said Jones, who served five years in prison after being convicted in 1990 of raping a 15-year-old girl when he was 17.

"I'm always preaching education to my children. How does that make me look if I'm not there at graduation?"

In August 2006, a state law went into effect prohibiting sex offenders from going onto school property without permission from the district superintendent. The only exceptions were government meetings or polling sites.

Rather than deal with individual requests, Buchanan County superintendents said they will ban all sex offenders from their schools.

"If I start deciding which offenders can and cannot be at school, then I become the judge. And it is not my position to judge a case. The courts have already done that," said St. Joseph School District Superintendent Melody Smith. "My job is to provide the safekeeping of 11,632 students and the people who attend our events."

Smith said she's denied requests by five offenders, four of whom visited her office.

"Half of them have been extremely sad about the decision, and half of them have been rudely angry," she said.

The county Board of Education, which would normally consider appeals, is so far backing Smith's decision.

Jones is not a registered sex offender as his offense happened before the state's sex offender registry law went into effect in 1995. That means he doesn't have to check in with the sheriff's department every 90 days, but he does have to follow other restrictions for sex offenders.

Sheriff's investigator Shawn Collie said although Jones has argued against the school property restriction more than any other offender, he has signed an agreement acknowledging he knows about the restriction. That means he can't claim ignorance if found on school grounds, such as for the May 22 graduation.

"We'll be there. And we'll arrest him if he's there," Collie said.

Actually with the new laws enacted and being RETROACTIVE people who "flash" others are added to the sexual offender registery. I don't condone what this guy did, but I beleive making them wear GPS monitors for the rest of thier lives goes far beyond cruel and unusual punishment.

It is definitely a sad situation and it easy for each of us to make judgements. Nowhere does it say if the **** conviction was for statutory or forcible ****. Given the ages, statutory **** seems likely but not absolute. I think the superintendent is looking at things in black and white. If she has had only 5 people request permission to attend school functions, how hard would it be to look at each circumstance. This is a disservice to all involved.

I know a very kind man that was arrested for r**ing his granddaughter. She lived with him because his daughter, her mother had died of cancer. When her mother very ill, she was not capable of providing proper guidance and she pretty much did as she wanted. Her grandfather placed too many restrictions on her and she didn't want that. His entire life was destroyed because she accused him of this unthinkable act because she not allowed to go out with her friends late on a school night. He lost his job, his life savings and the right to be around children. The charges remained in place for several years, and had not gone trial. One day the granddaughter told the truth, that she had lied because she was mad at him. This was so unfair because her life was not affected by any of this and his life was shattered. This is the other side of that crime.

There are so many unknown facts of this case, it is absolutely impossible to make any comments that are fair. The rules have been presented by the superintendent and he is aware of the penalty for disobeying them. He will make the right choice or be deemed guilty of this crime without question.

What do you do, just make stuff up then post???
This is the child's EIGHT GRADE graduation. He is not the result of the rape that took place 17 years ago. The father was convicted of RAPE. Not statutory rape (which is still a crime!) but of the forceable rape of a 15 year old girl.

This man has not served his sentence because part of his sentence is that he never be allowed on any school property. That means school plays, class trips and yes, even graduation.
BTW - is anyone else wondering how this guy managed to father a child 13 years ago when 17 years ago he was sentenced to 5 years in prison????

What does it hurt for him to be there. Is he the only one there with the graduating class. With all the other parents there watching, why can they not be safe. It is a redicilous for not allowing him to be there. This is his sons graduation and will mean the world to him in the future.
