Woman Jailed After Laughing Over Victim

TUCSON, Ariz. (Jan. 24) -- A judge sentenced a woman to nearly the maximum prison term for negligent homicide after hearing a recorded jail conversation in which she made light of the bicyclist she killed.

Melissa Arrington, 27, was convicted two months ago of negligent homicide and two counts of aggravated DUI in connection with the December 2006 death of Paul L'Ecuyer.

She could have gotten as few as four years behind bars, but Superior Court Judge Michael Cruikshank sentenced her Tuesday to 10½ years — one year shy of the maximum.

Cruikshank said he found a telephone conversation between Arrington and an unknown male friend, a week after L'Ecuyer was killed, to be "breathtaking in its inhumanity."

During the conversation, the man told Arrington that an acquaintance believed she should get a medal and a parade because she had "taken out" a "tree hugger, a bicyclist, a Frenchman and a gay guy all in one shot."

Arrington laughed. When the man said he knew it was a terrible thing to say, she responded, "No, it's not."

Assistant Public Defender Michael Rosenbluth told the judge his client has never been "cold, callous or flippant" about L'Ecuyer's death and has always felt remorseful.

Arrington said words couldn't express how she feels, and that once she's out of prison, she hopes to share her story with Mothers Against Drunk Driving.

L'Ecuyer, 45, was riding his bike the night of Dec. 1, 2006 when Arrington swerved off the road, hit him and then continued for 800 feet before stopping, according to Deputy Pima County Attorney Jonathan Mosher.

Arrington's blood-alcohol content was .156 percent, nearly double Arizona's .08 legal limit. She had been driving on a suspended license for a prior DUI.

It is estimated that fewer than 1 in 100,000 drunk drivers actually get into an accident. More people get into accidents because of cell phones. Yet where is Mother's Against Cell Phones? There is no such group. The anti-drinking movement has more to do with politically correct social engineering than it does with the actual results of drinking and driving. It's the insurance companies and local municipalities that are the beneficiaries of this movement. I'm not pro drunk driving. I'm just saying, statistically there are worse causes of accidents that go completely unpunished and unnoticed.

Let's get this straight. Some idiot is riding his bicycle on a busy road, gets hit by a car, and the driver of the car goes to jail because she had been drinking. Was the driver of the bicycle drinking? There's no mention of that. Sending this woman to jail for 10 years will do nothing but cost taxpayer's money. She would get the message that she has a problem if she served 6 months. I often see bicycle riders out on busy streets and they seem to have the attitude that they have the right of way. To me it looks like they must have a death wish riding in traffic like that.

Here we go again. Blame the victim. "Why would anyone ride a bike at night?" Try this one on for size. WHO DRIVES A MOTOR VEHICLE WHILE DRUNK?! Do I really need to answer this or can you idiots (those who drive while intoxicated) figure it out for yourself? #1. This woman had no legal right to be behind the wheel of a motor vehicle. Her license to drive had been suspended because of a previous DUI. #2. This woman's BAC was .156. 4/1000 of a point away from being twice over the legal limit to be considered DUI. #3. Her callous nature and complete lack of remorse for the victim and his family shows her true colors. She is deserving of a much harsher sentence than was allowed by law.

You know, the other thing that always amazes me is just how BAD these drunk drivers are at driving!!!! I mean I, and many people I've known over the years have somehow managed to keep it together while driving impaired and I don't think after 40 years of doing it we were just lucky! Keep it between the lines and drive steadily at an appropriate speed, guys!

As a life-long rider of 2 wheels (just fired up the bike to go to town today and got myself caught in the rain) I was intially inclined to accept the story the headline laid out. However, without the benefit of hearing the entire tape the judge had access to, I see that the only supposedly incriminating evidence from this tape available here claims that a joke was made by and "unknown male friend" and that she laughed at it. Not hard behavior to understand, under the circumstances. It seems to me, based on what I've read here, they out to sentence the man on the other end of the line if they want to prosecute someone for making fun of the loss of a man's life.
No. I do not approve of the joke. But I'll tell ya, if I were sitting in a jail cell and someone called to cheer me up I'd laugh at any joke they told me! Besides, we'll hear this joke over and over in stand up routines for the next few months, and then it'll be OK to tell it. Right?
