Man Sues Florist for Revealing Affair

HOUSTON (Aug. 10) -- A married man is suing 1-800-Flowers for $1 million for revealing that he was cheating on his wife.

Leroy Greer said in a lawsuit filed this week in a federal court in Texas that he bought flowers for his girlfriend through 1-800-Flowers. He asked to keep his purchase private.

Greer said he was referred to the company's privacy policy, which states that customers can ask 1-800-Flowers not to share personal information with "third parties."

But, the lawsuit says, 1-800-Flowers sent a thank-you note to his house and his wife saw it. When she called the company, 1-800-Flowers faxed her a copy of the receipt from Greer's secret purchase.

The receipt revealed that Greer had sent another woman a dozen long-stemmed red roses, along with a note that read, "Just wanted to say that I love you and you mean the world to me!" according to court documents.

The couple was already going through what Greer's attorney described as an amicable divorce.

After learning of the affair, Greer's wife asked for a $300,000 divorce settlement in addition to child support, said Kennitra Foote, Greer's attorney.

"That thank-you note is going to cost him money," Foote said.

Greer is asking for $1 million for breach of contract and deceptive trade practices.

"This is not a moral issue," Foote said. "The issue is, is 1-800-Flowers in the business of causing divorce or are they in the business of sending flowers and sticking to their privacy policy?"

A 1-800-Flowers spokesman said the company does not comment on pending litigation. In a statement, spokesman Steven Jarmon said, "We take all matters relating to our customers seriously; however, we are not responsible for an individual's personal conduct."

Stupid idiot is just mad because he got caught cheating. It's his own fault. She would have found out anyway when she got the credit card bill. I HATE CHEATERS!!!!!!

The florist didn't breach any contract if the wife's name was used in the purchase (joint credit card), which entitled her 100% to obtain any information regarding this purchase. She is responsible as well, for any purchases made on the same credit card that she shares with her husband. She was still legally married to the creep, so she would still be held liable, and has the right to question any purchases not recognized on the statement. The florist HAS to provide her with info after confirming that she is, indeed, on the credit card account. Period. Now, if he paid cash or with a card with his name only on it, then the florist would be guilty of providing unauthorized information that the wife has no privy to. Whatever...I'm just glad the jerk was caught and I hope that he's laughed right out of court.

Ya know, here's the bottom line ---------- doesn't matter WHO he is or WHO he sends flowers to. Obviously the florist has this come up often or they wouldnt have a 'privacy' clause. He invoked the privacy thing and the florist breached the contract. As far as him cheating or whatever, that's not even the issue. It's the breach of contract.

I agree with the JudOT22s comment on what the florists responsibilities are. How are they to know that the guy is getting a divorce or having an affair?
On the other side did they ask if he wanted a copy sent to his home? Was the wife opening mail she wasn't supposed to, not addressed to her? Isn't that another lawsuit in itself? The article didn't say it was a CC bill, just a receipt - which should be a private correspondence.
If they are getting a divorce, are they still living together? Why??
I don't think the receipt being sent is the problem at all but other issues related to the beginnings of this "amicable" divorce.

well ok, this is what I heard on the radio, he was reconciling with his wife when he sent the flowers to thhe girlfreind. It was his way of keeping her on the backburner. So a big DUH! for Leroy........oh yeah, if his wifes name IS on the credit card...sucks to be him!

well ok, this is what I heard on the radio, he was reconciling with his wife when he sent the flowers to thhe girlfreind. It was his way of keeping her on the backburner. So a big DUH! for Leroy........oh yeah, if his wifes name IS on the credit card...sucks to be him!
